We want to make your experience as smooth and relaxing as possible, so please review our terms and conditions before booking.

1. INTRODUCTION

These Terms and Conditions (the Terms) govern your access to and use of the wellness services, facilities and premises operated by Six Senses Wellness ABN12 690 822 943 located at 440 Forest Rd, Bexley NSW 2207  (Facility, we, us or our).

By booking, attending, accessing or using our Facility and services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Facility.

2. DEFINITIONS

In these Terms:

Booking means any booking, reservation or appointment made with the Facility.

Facilities means all wellness facilities, including but not limited to saunas, infrared saunas, traditional saunas, ice baths, cold plunge facilities, contrast therapy facilities, recovery rooms, red light therapy equipment, showers, change rooms and common areas.

Member means any person who purchases a membership with the Facility.

Services means all services provided by the Facility including wellness, recovery and therapeutic services.

Facility Rules means any policies, safety instructions, signage, operational procedures or directions issued by the Facility from time to time.

3. ELIGIBILITY AND AGE REQUIREMENTS

3.1 You must be at least 16 years of age to access or use the Facility and Facilities.

3.2 Persons under the age of 18 years must:

(a) have the consent of a parent or legal guardian;

(b) have a parent or guardian complete any required waiver or consent documentation; and

(c) comply with any additional requirements imposed by the Facility.

3.3 We reserve the right to request valid identification at any time.

3.4 The Facility may refuse entry or suspend access where a person:

(a) is under the age of 16 years;

(b) fails to provide identification when requested; or

(c) fails to comply with these Terms.

4. HEALTH AND MEDICAL ACKNOWLEDGEMENTS

4.1 By using the Facility and Facilities, you acknowledge and agree that:

(a) wellness activities, including sauna use, cold exposure, ice baths and red light therapy, involve inherent risks;

(b) participation may expose you to risks including dehydration, dizziness, fainting, overheating, burns, slips, falls, heart complications, allergic reactions, respiratory complications, injury, illness or death;

(c) you voluntarily assume all risks associated with participation;

(d) you are responsible for determining whether the Services and Facilities are appropriate for your physical condition and medical circumstances; and

(e) the Facility does not provide medical advice.

4.2 You must not use the Facilities if you:

(a) are pregnant, unless cleared by a medical practitioner;

(b) have cardiovascular disease, uncontrolled blood pressure, epilepsy, respiratory conditions, diabetes, neurological disorders or other relevant medical conditions without prior medical clearance;

(c) are under the influence of alcohol or drugs;

(d) have open wounds, contagious conditions or infections;

(e) feel unwell, dizzy or faint; or

(f) have been advised by a medical practitioner not to participate.

4.3 You acknowledge that red light therapy is not intended to diagnose, treat, cure or prevent any disease.

4.4 You agree to immediately cease use of the Facilities if you experience discomfort, illness, dizziness, pain or distress.

4.5 You must inform the Facility of any medical conditions, injuries or health concerns that may affect your safe participation.

5. ASSUMPTION OF RISK AND WAIVER

5.1 To the maximum extent permitted by law, you acknowledge and agree that:

(a) participation in the Services and use of the Facilities is undertaken entirely at your own risk;

(b) the Facility is not responsible for any injuries, illness, loss, damage or death arising from participation except where caused by the Facility’s negligence and where liability cannot lawfully be excluded; and

(c) you voluntarily accept all physical and mental risks associated with wellness and recovery activities.

5.2 You release and discharge the Facility, its directors, officers, employees, contractors and agents from all claims, demands, liabilities, actions or proceedings arising from or in connection with:

(a) your use of the Facilities;

(b) participation in the Services; or

(c) breach of these Terms,

except to the extent liability cannot be excluded under applicable law.

5.3 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by Australian Consumer Law or any other law that cannot lawfully be excluded.

6. FACILITY RULES AND CONDUCT

6.1 You agree to comply with all Facility Rules, signage, staff directions and safety instructions.

6.2 You must:

(a) behave respectfully toward staff and other patrons;

(b) use the Facilities safely and responsibly;

(c) maintain appropriate hygiene standards;

(d) shower before entering ice baths or saunas if requested;

(e) wear appropriate attire as directed by the Facility;

(f) use towels where required;

(g) immediately report hazards, accidents or injuries to staff; and

(h) leave the Facilities in a clean and tidy condition.

 6.3 You must not:

(a) engage in dangerous, reckless, threatening or abusive conduct;

(b) damage or misuse Facility property;

(c) bring glass objects into wet areas;

(d) use the Facilities while intoxicated;

(e) bring weapons, illegal substances or prohibited items into the Facility;

(f) engage in inappropriate or offensive behaviour; or

(g) photograph or film other patrons without consent.

6.4 We reserve the right to refuse entry, suspend or terminate access where a person breaches these Terms or poses a risk to health, safety or wellbeing.

7. BOOKINGS AND APPOINTMENTS

7.1 All bookings are subject to availability.

7.2 Bookings may be made online, through our booking platform, by phone or by any other approved method.

7.3 The Facility reserves the right to:

(a) amend schedules, operating hours or appointments;

(b) substitute services or equipment;

(c) cancel bookings where necessary for operational, safety or maintenance reasons; and

(d) refuse bookings at its discretion.

7.4 Late arrivals may result in reduced session times or refusal of entry where late entry would disrupt operations or compromise safety.

8. CANCELLATION AND NO-SHOW POLICY

8.1 Cancellations must be made at least 1 hour prior to the scheduled booking time unless otherwise stated in writing.

8.2 Where a cancellation is made less than 1 hour before the booking time:

(a) casual bookings may be forfeited and non-refundable;

(b) session credits may be forfeited; and/or

(c) cancellation fees may apply.

8.3 Failure to attend a booking without notice constitutes a no-show.

 8.4 No-shows may result in:

(a) forfeiture of the booking fee or session credit;

(b) suspension of booking privileges; and/or

(c) additional fees.

8.5 Membership holders who repeatedly cancel late or fail to attend bookings may have their memberships suspended or terminated.

8.6 The Facility may, in its discretion, waive cancellation fees in cases of emergency, illness or exceptional circumstances.

8.7 Refunds are not provided for:

(a) change of mind;

(b) unused memberships;

(c) partially used packs; or

(d) missed sessions,

except where required by law.

9. MEMBERSHIPS AND PAYMENTS

9.1 Membership fees, pricing and inclusions are as advertised by the Facility from time to time.

9.2 Memberships are non-transferable unless approved by the Facility in writing.

9.3 Members authorise the Facility to process recurring payments in accordance with the selected membership plan.

9.4 You must ensure your payment details remain current and valid.

9.5 Failed payments may result in:

(a) suspension of access;

(b) late fees;

(c) recovery action; and/or

(d) cancellation of membership.

9.6 Memberships may be paused only in accordance with any applicable membership policy or at the discretion of staff.

9.7 The Facility reserves the right to vary pricing on reasonable notice.

9.8 Promotional offers may be withdrawn or amended at any time.

10. PERSONAL PROPERTY

10.1 Personal belongings are brought into the Facility at your own risk.

10.2 The Facility is not responsible for loss, theft or damage to personal property, except where caused by the Facility’s negligence.

10.3 Lockers may be provided for convenience only.

11. HYGIENE AND SAFETY REQUIREMENTS

11.1 For health and safety reasons, you must:

(a) shower before using communal Facilities where requested;

(b) avoid using Facilities while sick or contagious;

(c) use towels and protective coverings as directed;

(d) follow all posted hygiene requirements; and

(e) immediately notify staff of spills, hazards or unsafe conditions.

11.2 The Facility reserves the right to remove any person who fails to comply with hygiene or safety standards.

12. RED LIGHT THERAPY CONDITIONS

12.1 You acknowledge that results from red light therapy may vary between individuals.

12.2 You must wear protective eyewear if directed.

12.3 You must disclose any medications, skin sensitivities or conditions that may increase light sensitivity.

12.4 The Facility is not responsible for adverse reactions where you fail to disclose relevant medical information.

13. SAUNA AND ICE BATH CONDITIONS

13.1 You acknowledge that exposure to heat and cold may create physical stress and health risks.

13.2 You agree to:

(a) remain hydrated;

(b) monitor your physical condition;

(c) exit the Facilities immediately if feeling unwell;

(d) comply with recommended session durations; and

(e) follow all safety guidance.

13.3 The Facility may impose maximum session times for health and safety reasons.

14. PHOTOGRAPHY AND SURVEILLANCE

14.1 CCTV surveillance may operate within parts of the Facility for security and safety purposes.

14.2 By entering the Facility, you consent to CCTV recording where applicable.

14.3 You must not photograph, video record or otherwise capture images of other patrons without their consent.

14.4 The Facility may use photographs or videos of the premises for promotional purposes, provided individuals are not identifiable without consent.

15. PRIVACY

15.1 The Facility collects, stores and uses personal information in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth).

15.2 Personal information may be collected for:

(a) bookings and memberships;

(b) health and safety purposes;

(c) communication regarding services;

(d) payment processing; and

(e) operational and legal compliance purposes.

15.3 By using the Facility, you consent to the collection and handling of your personal information in accordance with our Privacy Policy.

16. INTELLECTUAL PROPERTY

16.1 All intellectual property relating to the Facility, including branding, logos, content, programs and materials, remains the property of the Facility or its licensors.

16.2 You must not reproduce, distribute or exploit any Facility content without written consent.

17. LIMITATION OF LIABILITY

17.1 To the maximum extent permitted by law, the Facility excludes all liability for indirect, incidental, special or consequential loss.

17.2 Where liability cannot be excluded, the Facility’s liability is limited to:

(a) resupplying the relevant services; or

(b) refunding the cost of the relevant services,

at the Facility’s discretion.

17.3 Nothing in these Terms excludes any rights under the Australian Consumer Law that cannot lawfully be excluded.

18. INDEMNITY

18.1 You indemnify the Facility, its directors, employees, contractors and agents from and against any claims, losses, liabilities, damages, costs or expenses arising from:

(a) your breach of these Terms;

(b) misuse of the Facilities;

(c) negligent or unlawful conduct; or

(d) injury or damage caused by you.

19. SUSPENSION AND TERMINATION

19.1 The Facility may suspend or terminate your access immediately where:

(a) you breach these Terms;

(b) you engage in unsafe or inappropriate conduct;

(c) payment remains outstanding; or

(d) your conduct poses a risk to others.

19.2 Termination does not affect any accrued rights or obligations.

20. AMENDMENTS OF TERMS

20.1 The Facility reserves the right to amend these Terms from time to time.

20.2 Updated Terms will be published on the Facility website or otherwise made available.

20.3 Continued use of the Facility after changes are published constitutes acceptance of the updated Terms.

21. GOVERNING LAW

21.1 These Terms are governed by the laws of New South Wales, Australia.

21.2 You submit to the non-exclusive jurisdiction of the courts of New South Wales.

22. EMERGENCY AND MEDICAL ASSISTANCE

22.1 You authorise the Facility to seek medical treatment, emergency assistance or first aid on your behalf where reasonably necessary.

22.2 You acknowledge that you may be responsible for any associated medical or emergency costs.

23. SEVERABILITY

23.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
